Explanatory note

This Supplementary Order Paper amends the Immigration Amendment Bill. Detention has been shown to cause psychological illness, trauma, depression, anxiety, and to have other physical, emotional and psychological consequences. These consequences are likely to be in addition to the suffering and trauma that may have already been experienced by asylum seekers prior to arriving in New Zealand. This supplementary Order Paper amends clause 12 by inserting new section 317BA, which would ensure that New Zealand meets its obligations under the Refugee Convention in good faith, and the provisions under Article 10(1) of the International Covenant on Civil and Political Rights and Article 23(5) of the New Zealand Bill of Rights Act 1990, which provide that in cases where detention is deemed necessary, all persons deprived of their liberty shall be treated with humanity and with respect for the inherent dignity of the person.
