Proposed amendment
Metiria Turei, in Committee, to move the following amendment:
New clause 10A
After clause 10 (after line 31 on page 6), insert:
10A Amendment to Criminal Proceeds (Recovery) Act 2009
(1) This section amends the Criminal Proceeds (Recovery) Act 2009.
(2) In section 7, insert as subsection (2):
“(2) For the purposes of subsection (1), SKYCITY is taken to have knowingly derived a benefit from significant criminal activity if SKYCITY knew or should have known, having regard to best international practice in the detection of problem gambling and criminal activity, that the benefit to SKYCITY Casino is derived or likely to be derived from the proceeds of significant criminal activity.”
Explanatory note
This Supplementary Order Paper amends the New Zealand International Convention Centre Bill by inserting new clause 10A, which amends section 7 of the Criminal Proceeds (Recovery) Act 2009. New clause 10A inserts new section 7(2) to clarify that the definition of unlawfully benefited from significant criminal activity extends to SKYCITY Casino and that SKYCITY Casino is, for the purposes of the definition, taken to have knowingly derived a benefit from significant criminal activity if it knew or should have known, having regard to best international practice in the detection of problem gambling and criminal activity, that the benefit is derived or likely to be derived from the proceeds of significant criminal activity
