Proposed amendment
Denise Roche, in Committee, to move the following amendment:
New clause 8A
After clause 8 (after line 15 on page 6), insert:
8A New Zealand Bill of Rights Act 1990
The Minister must ensure that the right in clause 7.2 of schedule 16 of the Agreement is exercised consistently with the requirements of the New Zealand Bill of Rights Act 1990.
Explanatory note
This Supplementary Order Paper amends the New Zealand International Convention Centre Bill. This Supplementary Order Paper stipulates that the Crown’s ability to require SKYCITY to cancel bookings must be subject to and must be exercised consistently with New Zealand Bill of Rights Act guaranteed rights and freedoms. The Agreement gives the Crown the ability to require SKYCITY to cancel bookings at the New Zealand International Convention Centre “where it reasonably believes that the hosting of the relevant Event would be materially prejudicial to the international relations or to national security interests of New Zealand.” This has the potential to conflict with the rights guaranteed under the New Zealand Bill of Rights Act.
