(1) A person may apply for an authorisation under section 10 only if that person—

(a) is a West Coast registered company or operation; and

(b) has been invited to do so by the Director-General.

After clause 9(5) (page 5, after line 9), insert:

(6) The Director-General may only invite non-West Coast resident people to apply for an authorisation under subsection (3) if he or she has not received any applications from West Coast operations.

Clause 10

After clause 10(3)(a)(vi) (page 6, after line 4), insert:

(vii) the timber is released into the market in a managed way to avoid flooding the market; and

Explanatory note

This Supplementary Order Paper amends clause 9 to ensure the commercial value of the felled trees for the West Coast region and protect the conservation estate. This amendment ensures that West Coasters will have preferred access to the trees to create the jobs from this one-off event.

A new clause 10(3)(a)(vii) is inserted requiring the Director-General to be satisfied before they grant an authorisation that the additional volume of timber will be released in a managed way so as best to avoid a collapse in indigenous timber values and undermine existing West Coast business operations. Without such consideration the potential flooding of the market and effects on price and jobs would undermine local jobs rather than increase opportunities and so undermine the intention of this Bill.
