Proposed amendment to SOP No 203
Hon David Parker, in Committee, to move the following amendment to SOP No 203:
Clause 10
In new clause 10, after new section 6A(2), insert:

Despite subsection (1), if a Labour Inspector or the Authority or any Judge is asked to enforce this section, and in their opinion it would be unfair according to equity and good conscience to do so, then that person has the discretion not to apply this section.
Explanatory note
This Supplementary Order Paper provides a discretion to a Labour Inspector or the Employment Relations Authority or any Judge hearing a claim for payment of the proposed prescribed minimum rate of remuneration to a specified contractor not to apply proposed new section 6A if they consider it would be unfair according to equity and good conscience to do so.
