Simeon Brown, in Committee, to move the following amendment:
Clause 15
In clause 15(2), new section 292A(3), delete “, without reasonable excuse,”
(page 7, line 1).
Explanatory note
This Supplementary Order Paper amends the Education Amendment Bill. It amends clause 15 to remove the phrase “without reasonable excuse”
from new section 292A(3).
We do not think the court should have discretion to decide whether or not a person who has committed the offence of false representation has a reasonable excuse or not, as there is no reasonable excuse. The fees-free eligibility criteria are clearly outlined as part of the application process, and there is significant information on the Government’s Fees Free website for those who are unsure whether or not they meet these criteria.
