Proposed amendment
Denise Lee, in Committee, to move the following amendment:
Clause 15
In clause 15(2), replace new section 292A(4) (page 7, lines 4 and 5) with:
(4)
A person who commits an offence against subsection (3) is liable on conviction to a fine of the higher of—
(a)
$5,000; or
(b)
the amount of money gained from the false representation.
Explanatory note
This Supplementary Order Paper amends the Education Amendment Bill. It ensures that anyone who commits false representation does not benefit from this act of deception. Currently under the Bill, if a person’s deception benefits them to the sum of more than $5,000 then the punishment does not equal the crime. This amendment fixes that problem.
