Proposed amendment
Nicola Willis, in Committee, to move the following amendment:
Clause 15
In clause 15(2), replace new section 292A(4) (page 7, lines 4 and 5) with:

A person who commits an offence against subsection (3) is liable on conviction to a fine of $5,000 plus the amount of money gained from the false representation.
Explanatory note
This Supplementary Order Paper amends the Education Amendment Bill. It ensures the person committing the false representation not only has to repay the amount they falsely attained but are also then forced to pay a fine on top of this repayment. Merely paying back the amount they receive falsely only puts them back in the position they were in before the false representation. This amendment ensures there is a deterrent to false representation, as the person is put in a worse position by falsely representing themselves.
