Electoral (Integrity) Amendment Bill

Proposed amendment

Hon Dr Nick Smith, in Committee, to move the following amendment:

New clause 5A

After clause 5 (page 4, after line 16), insert:

5A Section 59A inserted (Proceedings of Parliament available for court or tribunal relating to vacancy)

After section 59, insert:

Parliamentary privilege and court proceedings relating to vacancy

59A Proceedings of Parliament available for court or tribunal relating to vacancy

In proceedings in a court or tribunal relating to any vacancy under section 55A(2), the following proceedings of Parliament are available for the sole purpose of assisting the court or tribunal to decide the proceedings, despite any provision of the Parliamentary Privilege Act 2014:

(a)

any written transcript of debate in the House, committee of the whole House, or select committee:

(b)

any audio or video recording of debate in the House, committee of the whole House, or select committee:

(c)

any select committee report:

(d)

any other relevant proceedings in Parliament under section 10 of the Parliamentary Privilege Act 2014.

Explanatory note

This Supplementary Order Paper amends the Electoral (Integrity) Amendment Bill to insert new clause 5A.
