Proposed amendment
Nicola Willis, in Committee, to move the following amendment:
Clause 5
In clause 5, new section 55D, replace paragraph (a) (page 3, lines 10 to 13) with:
(a)
state that the parliamentary leader has proved on the balance of probabilities that the member of Parliament concerned has acted in a way that has distorted, and is likely to continue to distort, the proportionality of political party representation in Parliament as determined at the last general election; and
Explanatory note
This Supplementary Order Paper amends the Electoral (Integrity) Amendment Bill. It amends clause 5 to ensure the burden of proof is on the leader of a party that wishes to expel an MP to demonstrate that the MP has acted in a way that has distorted or is likely to distort proportionality.
