Proposed amendments

Hon Anne Tolley, in Committee, to move the following amendments:

Clause 49

In clause 49(3), replace paragraph (i) (page 32, lines 36 to 39) with:

(i)

provide for the Minister of Fisheries to consider and, by notice in the Gazette, make bylaws that are proposed by a fisheries management committee,—

(i)

after the Minister satisfies the relevant requirements in the deed of agreement; and

(ii)

only if the Minister is satisfied that it will not prevent persons with a commercial interest in a species taking their quota entitlement or annual catch entitlement within the quota management area for that species:

Clause 84

In clause 84, replace paragraph (b) (page 48, lines 26 to 30) with:

(b)

provide—

(i)

for fisheries management committees to propose bylaws for any customary marine title area that is covered by a fisheries management plan; and

(ii)

for the Minister of Fisheries to consider and make the bylaws referred to in subparagraph (i)—

(A)

after the Minister satisfies the relevant requirements in the deed of agreement; and

(B)

Explanatory note

This Supplementary Order Paper amends clauses 49 and 84 of the Ngā Rohe Moana o Ngā Hapū o Ngāti Porou Bill (No 2).
