Proposed amendments
Sarah Dowie, in Committee, to move the following amendments:
Clause 7
In the heading to clause 7, replace “26ZHD”
(page 4, line 3) with “26ZHE”
.
In clause 7, new section 26ZHB(1), replace “section 26ZHC(1)(a) or 26ZHD”
(page 4, line 16) with “section 26ZHC(1)(a), 26ZHD, or 26ZHE”
.
In clause 7, after new section 26ZHD (page 5, after line 38), insert:
26ZHE Taking of whitebait
(1)
A person may fish for whitebait from a conservation area in accordance with the Whitebait Fishing Regulations 1994 or Whitebait Fishing (West Coast) Regulations 1994.
(2)
The Director-General—
(a)
must not take any action that would prohibit, or result in the effective prohibition of, the taking of whitebait in a conservation area; but
(b)
must otherwise take any actions necessary to ensure that the whitebait fishery is sustainably managed, including measures such as—
(i)
temporary restrictions within a conservation area for a prescribed period of time:
(ii)
imposing time limits for fishing:
(iii)
restricting net size:
(iv)
limiting the number of nets per person.
Clause 16A
In clause 16A, new Part 2 of Schedule 1AA, delete clause 4 (page 11, lines 28 to 33).
Explanatory note
This Supplementary Order Paper amends the Conservation (Indigenous Freshwater Fish) Amendment Bill to remove whitebait from the ban on fishing on conservation estate rivers and provide for the Director-General to ensure that the whitebait fishery is sustainably managed.
