Conservation (Indigenous Freshwater Fish) Amendment Bill
Proposed amendment
Sarah Dowie, in Committee, to move the following amendment:
Clause 9
In clause 9, new section 26ZJA, after subsection (1), insert:
(1A)
If the Director-General declares an area on private property to be a spawning area, the Director-General must—
(a)
consult the property owner; and
(b)
provide for an appeal process, which must include a right for the property owner to be heard; and
(c)
give effect to the property owner’s right to justice under section 27 of the New Zealand Bill of Rights Act 1990.
Explanatory note
This Supplementary Order Paper amends the Conservation (Indigenous Freshwater Fish) Amendment Bill to create a consultation and appeal process for affected landowners when a spawning area is declared on their property.
