Proposed amendment
Chris Bishop, in Committee, to move the following amendment:
Clause 49
In clause 49, replace new sections 222N and 222O (page 24, line 30 to page 25, line 13) with:
222N Open Polytechnic of New Zealand Limited to have full management and control of assets
(1)
Despite anything to the contrary in this Act or the Crown Entities Act 2004, the Open Polytechnic of New Zealand Limited is not required to comply with any direction given by the Secretary or NZIST regarding the use of its assets.
(2)
Despite subsection (1), Schedule 23 continues to apply if the Open Polytechnic of New Zealand Limited is dissolved.
(3)
To avoid doubt, section 192(4) does not apply to the Open Polytechnic of New Zealand Limited.
Explanatory note
This Supplementary Order Paper seeks to ensure that the Open Polytechnic of New Zealand Limited has management and control of its assets.
