Proposed amendments
Hon Nicky Wagner, in Committee, to move the following amendments:
Clause 26
In clause 26, replace new section 53(2A), (page 36, lines 34 to 36) with:
(2A)
A person must not import for sale, sell, pack, or distribute any oral nicotine product unless—
(a)
it is a notifiable product that has been notified in accordance with Part 4; or
(b)
the Minister of Health has given consent or provisional consent to the distribution of the product under the Medicines Act 1981.
In clause 26, new section 58, definition of notifiable product, paragraph (b), replace “product”
(page 38, line 24) with “product; or”

In clause 26, new section 58, definition of notifiable product, after paragraph (b) (page 38, after line 24), insert:
(c)
non-tobacco nicotine pouch
Explanatory note
This Supplementary Order Paper amends the Smokefree Environments and Regulated Products (Vaping) Amendment Bill to make non-tobacco nicotine pouches a notifiable product for the purpose of the Bill and, when such a product is notified in accordance with Part 4 of the Bill, to remove it from the prohibition on the sale and distribution of oral nicotine products under new section 53(2A). This recognises the utility of non-tobacco nicotine pouches as an aid to help smokers quit.
