Canterbury Regional Council (Ngāi Tahu Representation) Bill

Proposed amendment

Simon Court, in Committee, to move the following amendment:

New clause 9A

After clause 9 (page 5, after line 36) insert:

9A Demand to vacate position of appointed member

(1)

A specified number of electors may, at any time, demand that an appointed member vacate office.

(2)

A demand must be made by notice in writing—

(a)

signed by a specified number of electors; and

(b)

delivered to the principal office of the Council.

(3)

An elector may sign a demand and be treated as one of the specified number of electors only if—

(a)

the name of the elector appears on the electoral roll of a territorial authority and the elector’s address as shown on that roll is within the Canterbury region; or

(b)

in a case where the name of an elector does not appear on a roll in accordance with paragraph (a),—

(i)

the name of the elector is included on the most recently published electoral roll for any electoral district under the Electoral Act 1993 or is currently the subject of a direction by the Electoral Commission under section 115 of that Act (which relates to unpublished names); and

(ii)

the address for which the elector is registered as a parliamentary elector is within the local government area of the Council; or

(c)

the address given by the elector who signed the demand is—

(i)

confirmed by the Electoral Commission as the address at which the elector is registered as a parliamentary elector; and

(ii)

within the Canterbury region; or

(d)

the elector has enrolled, or has been nominated, as a ratepayer elector and is qualified to vote as a ratepayer elector in elections of the Council.

(4)

Every elector who signed a demand must state, against their signature,—

(a)

their name; and

(b)

the address for which they are qualified as an elector of the Council.

(5)

The chief executive of the Council must, as soon as practicable, give notice to TRoNT of every valid demand made for the recall of an appointed member made in accordance with this section.

(6)

Upon delivery of notice to TRoNT in accordance with subsection (5), the position of the appointed member is immediately vacated for the purposes of section 9 of this Act.

(7)

A person who has vacated office under this section is disqualified from further appointment under section 7 of this Act.

(8)

In this section,—

demand means a demand referred to in subsection (1)

region has the same meaning as in section 5(1) of the Local Government Act 2002

specified number of electors means a number of electors equal to or greater than 10% of the number of electors enrolled as eligible to vote at the previous triennial general election of the Council.

Explanatory note

This Supplementary Order Paper would give voters the ability to demand that an appointed member be recalled. Members of the regional council should be democratically elected. If there are undemocratically appointed members, then there must, at minimum, be an ability for the voters to recall those members.
