Oversight of Oranga Tamariki System and Children and Young People’s Commission Bill
Proposed amendments
Karen Chhour, in Committee, to move the following amendments:
New clause 2A
After clause 2 (page 7, after line 8) insert:
2A Repeal of this Act
(1)
This Act, and the amendments made by this Act to other enactments, are repealed on 1 April 2025 if no resolution is passed to continue the Act by the House of Representatives before that time.
(2)
On the repeal, the provisions amended by this Act are restored as if those amendments had not been made by this Act.
(3)
However, the restoration does not otherwise affect the previous operation of the amended provisions or anything done under them.
(4)
No resolution may be made under this section before 1 January 2025.
(5)
A resolution under this section is secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
Clause 57
In clause 57 replace subclause (3) (page 34, lines 18 and 19) with:
(3)
The review must commence no later than 6 months after the delivery to the Minister of the report of the Royal Commission of Inquiry into Abuse in Care and must be completed no later than 12 months after its commencement.
Clause 118
In clause 118 replace subclause (3) (page 56, lines 4 and 5) with:
(3)
The review must commence no later than 6 months after the delivery to the Minister of the report of the Royal Commission of Inquiry into Abuse in Care and must be completed no later than 12 months after its commencement.
Explanatory note
This Supplementary Order Paper amends the Oversight of Oranga Tamariki System and Children and Young People’s Commission Bill. It would require the Act arising from the passage of this bill to be reviewed no later than 6 months after the report of the Royal Commission of Inquiry into Abuse in Care is delivered to the Minister and for the review to be completed no later than 12 months after its commencement. It would also require the Act arising from the passage of this Bill to be confirmed by the House of Representatives by 1 April 2025, or the Act would repeal itself.
