New clause 2A
After clause 2 (page 2, after line 8), insert:
2A Repeal of this Act
(1)
This Act, and the amendments made to the principal Act by this Act, is repealed on 1 July 2023 if no resolution is passed to continue the Act by the House of Representatives before that time.
(2)
No resolution may be made under this section before 1 May 2023.
(3)
A resolution under this section is secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
(4)
The Clerk of the House of Representatives must lodge a copy of the resolution with the Parliamentary Counsel Office for the purpose of publication under the Legislation Act 2019.
(5)
However, subsection (1) applies even if the copy is not yet published.

54A Review of ban on live animal exports
(1)
The Ministry must, within 6 months after the commencement of the Animal Welfare Amendment Act 2021,—
(a)
review the prohibition on the application for an issuance of animal welfare export certificates; and
(b)
consider whether the animal welfare export certificate process could be reinstated under prescribed conditions and criteria; and
(c)
consider whether any amendments to this Act are therefore necessary or desirable; and
(d)
report on its findings to the Minister.
(2)
As soon as practicable after receiving a report under subsection (1)(d), and in any case no later than 31 April 2023, the Minister must present a copy of the report to the House of Representatives.
(3)
If by 31 April 2023, the Ministry has not yet provided the Minister with a report under subsection (1)(d), the Minister must inform the House that no such report has been received.
Explanatory note
This Supplementary Order Paper amends the Animal Welfare Amendment Bill. It would require the Act arising from the passage of this Bill to be confirmed by the House of Representatives by 1 July 2023, or the Act would repeal itself. It would also require the Ministry of Primary Industries to review the prohibition on live export six months after it comes into force, consider whether the prohibition should be changed or reversed, and then report back to the Minister before any resolution confirming the Act is made.
