Accident Compensation (Maternal Birth Injury and Other Matters) Amendment Bill
Proposed amendment
Jan Logie, in Committee, to move the following amendment:
Clause 6(1)
In clause 6(1), replace new section 25(1)(f) (page 3, lines 25 to 27) with:
(f)
an application of a force or resistance internal to the human body at any time from the onset of labour to the completion of delivery that results in an injury, to a person who gives birth or to a person who is born, that is either —
(i)
described in Schedule 3A; or
(ii)
of a kind generally accepted by the medical profession as caused by labour or delivery.
Explanatory note
This Supplementary Order Paper amends the Accident Compensation (Maternal Birth Injury and Other Matters) Amendment Bill. The effect of the amendment is to create a general provision for all injuries that may result from labour or delivery to go alongside the injuries specified in Schedule 3A, rather than just a closed list of injuries that may exclude some rare birth injuries.
A general test will ensure all injuries to the person who gives birth or is born that are of a kind generally accepted by the medical profession as caused by labour and delivery are included in the Bill.
