Accident Compensation (Maternal Birth Injury and Other Matters) Amendment Bill
Proposed amendments
Jan Logie, in Committee, to move the following amendments:
Clause 8
Delete clause 8(1) (page 3, lines 33 and 34).
In clause 8(2), after “section 30(2)(b)(ii)”
insert “and (2)(c)”

Delete clauses 8(3) and (4) (page 4, lines 1 to 15).
Schedule 1: new Part 3 of Schedule 1AA
In Schedule 1, new Part 3 of Schedule 1AA, clause 11(2), replace “as if section 8 of the amendment Act had not been enacted.”
(page 8, lines 2 and 3) with “on the basis of this Act as amended by section 8 of the amendment Act.”

Explanatory note
This Supplementary Order Paper amends the Accident Compensation (Maternal Birth Injury and Other Matters) Amendment Bill.
The effects of the amendments in this Supplementary Order Paper are:
to remove the requirement that, in order to be covered under the Act, a personal injury caused by a work-related gradual process, disease, or infection must be caused in work circumstances where the risk of suffering the personal injury is significantly greater than for person who do not carry out that type of work, or do not work in that type of work environment:
to change the transitional arrangements in relation to claims for a personal injury caused by a work-related gradual process, disease, or infection that are made, but not decided, before the presumption comes into effect. This will mean that those yet-to-be decided claims have the benefit of the change described above.
