Proposed amendments
Jan Logie, in Committee, to move the following amendments:
Clause 7
Replace clause 7 (page 4, lines 10 and 11) with:
7 Section 26 amended (Personal injury)
In section 26(1A), delete “that is 6% or more of binaural hearing loss”

Schedule 1: new Part 3 of Schedule 1AA
In Schedule 1, new Part 3 of Schedule 1AA, clause 10(2), replace “as if section 7 of the amendment Act had not been enacted.”
(page 7, lines 24 and 25) with “on the basis of this Act as amended by section 7 of the amendment Act.”

Explanatory note
This Supplementary Order Paper amends the Accident Compensation (Maternal Birth Injury and Other Matters) Amendment Bill. The effects of the amendments are to:
remove the threshold of hearing loss introduced in 2010, so that any binaural hearing loss caused by a personal injury would be covered under the Accident Compensation Act 2001. Currently, the Bill provides for the threshold to be reduced from 6% of hearing loss to 5% of hearing loss.
change the transitional arrangements in relation to claims for hearing loss that are lodged, but not decided, before the threshold is removed. This will mean that those yet-to-be decided claims have the benefit of the removal of the threshold.
