Proposed amendments

Clause 14
In clause 14, new section 72A(2A)(c), replace “; and”
(page 10, line 36) with “.”

In clause 14, new section 72A(2A), delete paragraph (d) (page 10, lines 37 and 38).
Explanatory note
This Supplementary Order Paper amends the Fisheries Amendment Bill. It would amend clause 14 to delete new section 72A(2A)(d).
New section 72A(2A) of the Fisheries Act 1996, as inserted by clause 14, sets out the factors the Minister must have regard to in considering exceptions to the landing rules and considering the acceptable likelihood of survival of a stock or species. Requiring the Minister to have regard to “the social, cultural, and economic factors that the Minister considers relevant” when considering exceptions provides too much discretion for the Minister and undermines the intent of the new landing and discards provisions. This Supplementary Order Paper deletes this provision.
