Proposed amendments
Karen Chhour, in Committee, to move the following amendments:
Clause 5
In clause 5, replace “concerns about safety or well-being”
(page 3, lines 16 and 17) with “ill-treatment, neglect, or concerns about safety”
Clause 6
In clause 6, replace new section 18B (page 4, lines 1 to 5) with:
18B Person described in this section
A person described in this section is a person who—
(a)
has been convicted under the Crimes Act 1961 of the murder, manslaughter, or infanticide of a child or young person who was in the person’s care or custody at the time of the child’s or young person’s death:
(b)
has been—
(i)
convicted under any of sections 188 to 204 of the Crimes Act 1961 of an offence involving the assault or injury of a child or young person who was in the person’s care or custody at the time of the offence; and
(ii)
sentenced to a term of imprisonment of at least 3 months in relation to the offence in subparagraph (i).
Explanatory note
This Supplementary Order Paper amends the Oranga Tamariki Amendment Bill (the Bill). ACT agrees with the sentiment of the Bill’s partial repeal of subsequent-child provisions, but believes the threshold for triggering these provisions is being raised too far.
While the Bill currently provides that the murder or manslaughter of a child would trigger subsequent-child provisions, this SOP would amend the Bill to ensure that having been sentenced to a prison term of at least 3 months for a violent offence against a child in one’s custody would also meet this threshold.
This SOP also amends clause 5 of the Bill. The replacement of “ill-treatment or neglect” with “concerns about safety or well-being” is a needless and imprecise dilution of accurate language in the Oranga Tamariki Act 1989. The amendment would retain the original language in the heading to section 17 as well as adding “concerns about safety,” while removing the vague reference to “well-being” from the Bill.
