This Supplementary Order Paper seeks to amend the Water Services Entities Bill, which currently defines overland flow paths and green stormwater infrastructure as part of stormwater networks. This would, in practice, make these assets eligible for transfer to water service entities in subsequent legislation.

This amendment would change the Bill so green stormwater infrastructure and overland flow paths are not considered part of the stormwater network and would not be included within the scope of the proposed water services entities. By explicitly excluding these from the definition of stormwater network, this will ensure these assets, which could include assets that serve functions as recreation or green areas in addition to their use as stormwater assets, stay within the ownership and management of territorial authorities.
