Proposed amendments
Hon Eugenie Sage, in Committee, to move the following amendments:
Clause 19
Delete clause 19 (page 13, line 25 to page 14, line 19).
Clause 20
Delete clause 20 (page 14, lines 20 to 31).
Clause 21
Delete clause 21 (page 14, lines 32 to 35).
Explanatory note
This Supplementary Order Paper amends the Severe Weather Emergency Recovery Legislation Bill to delete clauses 19 to 21,
The ability in Clause 19 for the Executive to use the Order in Council process to add other acts to the list in Schedule 2 that can be amended by Orders in Council, again with no prior consideration by, or input from Parliament, is a significant increase in Executive power. The Bill provides for a parliamentary resolution to approve such an Order in Council within a specified period after it has been made. The deletion of clauses 19, 20, and 21 would provide for normal parliamentary scrutiny by ensuring that Parliament can debate and select committee and the public can consider whether the Executive should be able to amend additional legislation by Order in Council.
