Proposed amendments
Ricardo Menéndez March, in Committee, to move the following amendments:
Clause 4
In the heading to clause 4, replace “New section 275A” (page 3, line 11) with “New sections 275A and 275B”.
In clause 4, after new section 275A (page 4, after line 13), insert:
275B Restriction on use of information obtained under section 275A for subsequent visa assessments
Information obtained under section 275A(2) must not be used to inform the assessment of any subsequent visa applications.
Explanatory note
This Supplementary Order Paper amends the Worker Protection (Migrant and Other Employees) Bill to provide migrant employees more assurance that any information (including wages and time records) obtained through the document production power to assess employer compliance under new section 275A(2) could not be used in the assessment of their future visa applications. This is intended to ensure that migrant employees feel safer when engaging with this new process in situations where exploitative conditions may mean that the information obtained for assessing employer compliance also shows non-compliance of the employee with their visa conditions.
