Proposed amendments
Joseph Mooney, in Committee, to move the following amendments:
Clause 44
Replace clause 44, new section 87U(3)(a) (page 34, lines 3 to 5) with:
(a)
the vehicle is equipped with a toilet that—
(i)
is permanently fixed to the vehicle and usable within the vehicle; or
(ii)
is portable and otherwise meets the requirements set out in regulations made under section 172(1)(ga); and
Clause 48
After clause 48(1) (page 39, after line 27), insert:

After section 172(1)(g), insert:
(ga)
prescribing the requirements that toilets (other than fixed toilets) must meet in order to be considered self-contained:
After clause 48(3) (page 39, after line 32), insert:

The Governor-General must make regulations for the purposes of subsection (1)(ga) within 12 months of the commencement of the Self-contained Motor Vehicles Legislation Act 2022.
Schedule
Replace clause 3(2) of new Schedule 1AA (page 44, lines 7 to 11) with:

Clause 6.1 of the existing standard is replaced with the following text:
6.1 Minimum requirements
The motor caravan or caravan shall be equipped with a toilet that is—
(a)
permanently fixed to the motor caravan or caravan, in accordance with the manufacturer’s instructions; or
(b)
otherwise meets the requirements set out in regulations made under section 172(1)(ga) of the Plumbers, Gasfitters, and Drainlayers Act 2006.
Explanatory note
This Supplementary Order Paper amends the Self-contained Motor Vehicles Legislation Bill to allow some vehicles with non-fixed toilets to be certified as “self-contained”. This will be done by requiring the standards which define “self-contained” to be amended via regulation within 12 months of the legislation receiving Royal assent.
