Proposed amendment
Andrew Bayly, in Committee, to move the following amendment:
New clause 48A
After clause 48 (page 22, after line 25), insert:
48A Review of Act
(1)
The Minister must, within 1 year after the commencement of this Act and then at subsequent intervals of not more than 2 years, arrange for an independent review of the operation and effectiveness of this Act.
(2)
The review must consider—
(a)
whether the operation of this Act is meeting the purpose set out in section 3; and
(b)
whether related government policies, including policies relating to electronic invoicing, have improved the payment terms and practices of entities in relation to small business suppliers; and
(c)
the cost of the administration and implementation of the Act.
(3)
An independent review arranged in accordance with this section must report on its findings to the Minister within 6 months of the review being initiated.
(4)
The Minister must present a copy of the report to the House of Representatives as soon as practicable after receiving it.
Explanatory note
This Supplementary Order Paper (SOP) amends the Business Payment Practices Bill. The purpose of the SOP is to introduce a statutory review of the Act, following the practices done in Australia’s Payment Times Reporting Act 2020, section 57B. The purpose of the review is to consider whether the Business Payment Practices Bill meets the purpose of improving payment terms and practices of entities to small business suppliers and the cost of the administration and implementation of the Act.
