Proposed amendments
Dr Shane Reti, in Committee, to move the following amendments:
Clause 16
Replace clause 16(2A) (page 31, line 32 to page 32, line 1) with:
(2A)
A product is not a therapeutic product under subsection (1)(a) if—
(a)
it is a food, as defined in section 9 of the Food Act 2014 (but disregarding section 9(1)(c)(iii)),—
(i)
for which there is an adopted joint food standard in force under the Food Act 2014 that is applicable to the product; and
(ii)
that if it were a therapeutic product would be an NHP; or
(b)
it is a sunscreen product, as defined in section 3 of the Sunscreen (Product Safety Standard) Act 2022.
Clause 383
In the heading to clause 383, replace “Repeal and revocations” (page 210, line 4) with “Revocations”.
In clause 383, delete subclause (1) (page 210, line 5).
Schedule 1
In Schedule 1, clause 27, delete subclause (4) (page 236, lines 9 to 12).
Explanatory note
This Supplementary Order Paper (SOP) amends the Therapeutic Products Bill. The Sunscreen (Product Safety Standard) Act 2022 came into force on 8 September 2022, with a transition period to 8 September 2023 for the establishment of the product safety standards created by that Act. Manufacturers have been taking the steps necessary to be compliant with the legislation. The Therapeutic Products Bill would repeal the Sunscreen (Product Safety Standard) Act before the transition period has expired, causing further uncertainty and, potentially, wasted effort. Sunscreens are well regulated under the Sunscreen (Product Safety Standard) Act and the applicable standards. This SOP seeks to retain the current regulations, which are considered suitable by the Commerce Commission, as the monitoring entity.
