Clause 5
In clause 5(2), delete “(a) and”
(page 2, line 17).
After clause 5(2) (page 2, after line 18), insert:

To avoid doubt, in observing the obligation under section 4 to deal in good faith with the employee, the employer must comply with section 4(1A)(c) in making a decision whether to terminate an employment agreement under this section.
Explanatory note
This Amendment Paper amends the Employment Relations (Trial Periods) Amendment Bill. It will ensure that proper and well-established employment principles are followed in the use of trial periods. This will help safeguard against employers who are too hasty with dismissal under trial periods and ensure they have considered all options before ending someone’s employment.
