Clause 35
In clause 35, new subsection (3) of section 92, after “limited authority to teach”
(page 14, line 21), insert “, unless the limited authority to teach is suspended under section 498 or 500(1)(d)”
.
Clause 43A
Delete clause 43A (page 33, lines 31 to 5).
Clause 43B
Delete clause 43B (page 34, lines 1 to 5).
Clause 44
Delete clause 44 (page 34, lines 6 to 10).
Clause 45
Delete clause 45 (page 34, lines 11 to 18).
Clause 46
Delete clause 46 (page 34, lines 19 to 29).
Explanatory note
This Amendment Paper amends the Education and Training Amendment Bill. Under the amendments made in clause 60, the Teaching Council is still responsible for granting limited authority to teach, so it would then be inconsistent for the Teaching Council to not be responsible for or made aware of any complaints or incompetencies relating to an authority that it has granted. Additionally, anyone who permanently holds a limited authority to teach should be subjected to competency review, because they, in effect, function like a teacher. However, it would be up to the Competence Authority, and the powers granted to it, to decide the necessary level of competence for those with limited authority to teach in a charter school.
