Proposed amendments
Dr Lawrence Xu-Nan, in Committee, to move the following amendments:
Clause 53A
In clause 53A, heading to new section 601A, replace “charter school”
with “not-for-profit charter school”
.
In clause 53A, new section 601A(1), replace “charter school”
with “not-for-profit charter school”
in each place.
Schedule 1
In Schedule 1, new Part 6 of Schedule 1, clause 125, replace subclause (1) (page 48, lines 24 to 28) with:
(1)
This clause applies if—
(a)
a converted school is being operated not-for-profit; and
(b)
the board of the converted school was, before its conversion, a party to a written arrangement (for example, a memorandum of understanding), whether legally binding or not, with the boards of 1 or more other State schools regarding the sharing of education services, employees, or students.
Explanatory note
This Amendment Paper amends the Education and Training Amendment Bill. The provisions in new section 601A and in new clause 125 of Schedule 1 should not be used by for-profit charter schools as means for cost saving. Specifying that these apply only to not-for-profit charter schools would avoid this scenario.
