Proposed amendments
Tamatha Paul, in Committee, to move the following amendments:
Clause 27
In clause 27(1), replace new paragraph (c) (page 15, lines 6 and 7) with:
(c)
at least 21 days before the expiry, the tenant gives the landlord written notice of the tenant’s intention not to continue with the tenancy; or
(ca)
at least 90 days before the expiry, the landlord gives the tenant written notice of the landlord’s intention not to continue with the tenancy; or
In clause 27, delete subclause (3) (page 15, lines 11 to 13).
Explanatory note
This Amendment Paper amends the Residential Tenancies Amendment Bill. It extends, from 21 to 90 days, the time period required for a landlord to give notice that, at the expiry of a fixed term tenancy, the tenancy will not renew as a periodic tenancy.
The 21 days currently in the Bill is not adequate notice for a tenant to find a new home should their tenancy not renew as a periodic tenancy. Increasing this to 90 days provides more time, and is consistent with the notice period for the no-cause termination of a tenancy.
