Schedule 1
In Schedule 1, new Part 8 of Schedule 1AA, after clause 43 (page 19, after line 20) insert:
43A Termination by notice
The amendments made by section 22 of the 2024 Act apply to a tenancy only where the tenancy commenced on or after the commencement date.
Explanatory note
This Amendment Paper amends the Residential Tenancies Amendment Bill. It limits the changes to no-cause evictions and notice periods to tenancies that start after this Bill comes into force.
Thousands of renters have entered tenancy agreements under the existing termination provisions, and it is unfair for terms to be changed after those agreements have been signed and committed to. It is unfair for tenants who have entered a tenancy agreement on the basis of fair and reasonable evictions to have that protection moved out from under them. Many tenants would not have entered their tenancy agreement had they not had the security of fair and reasonable eviction provisions.
