Proposed amendment
Steve Abel, in Committee, to move the following amendment:
Clause 4
In clause 4, in new section 165ZFHB, insert as subsections (2) and (3) (page 3, after line 16):

Despite subsections (1)(c) and (d), this subpart does not apply to coastal permits for existing marine farms within an inappropriate area for existing aquaculture activities.
(3)
In subsection (2), inappropriate area for existing aquaculture activities has the meaning set out in regulation 6 of the Resource Management (National Environmental Standards for Marine Aquaculture) Regulations 2020.
Explanatory note
This Amendment Paper amends the Resource Management (Extended Duration of Coastal Permits for Marine Farms) Amendment Bill. Regulation 6 of the Resource Management (National Environmental Standards for Marine Aquaculture) Regulations 2020 defines an inappropriate area for existing aquaculture activities to be an area of the coastal marine area that, after 1 January 2019, has been identified as inappropriate for existing aquaculture activities in a policy statement or plan or proposed policy statement or plan.
