Clause 40
In clause 40, new section 212Q(1), replace “any person”
(page 24, line 13) with “the chief executive or the person responsible for teaching and learning at the school”
.
Explanatory note
This Amendment Paper amends the Education and Training Amendment Bill. The existing term “any person” is too broad for the delegated power that they may hold with very little vetting or accountability. This amendment specifies that the sponsor may only delegate their functions, duties, or powers to either the chief executive or the person responsible for teaching and learning at the school. Considering that new section 212O explicitly states the purview or qualities of the chief executive or the person responsible for teaching and learning, they would be the most suitable in terms of delegation.
