Dr Lawrence Xu-Nan, in Committee, to move the following amendments:
Clause 40
In clause 40, new section 212V, after subsection (1) (page 27, after line 9), insert:
(1A)
The sponsor must ensure that the parent or other person who has accepted the responsibility for the education of a prospective student of the charter school is given, before enrolment is completed, full details in writing of any property maintenance fee charged under this section.
In clause 40, new section 212V(4)(b), replace “:”
(page 27, line 21) with “.”

In clause 40, new section 212V(4), delete paragraph (c) (page 27, lines 22 and 23).
Explanatory note
This Amendment Paper amends the Education and Training Amendment Bill. New section 212V currently does not explicitly state that parents must be informed or notified in writing of the full requirements for any property maintenance fee prior to enrolment. New section 212V(2) creates only the requirement for a parent or other person who has accepted the responsibility for the education of a student at a charter school to pay, not the responsibility of the sponsor to notify or inform them. New section 212V(3) concerns only the contractual relationship between the sponsor and the Authorisation Board. This amendment would clarify this concern.
This amendment also deletes new section 212V(4)(c) allowing the use of property maintenance fees to service debts, mortgages, liens, or other charges. It would be inappropriate, particularly for for-profit charter school sponsors, to use property maintenance fees as a workaround to charge fees.
