Clause 8
In clause 8, delete subsections (3) and (4) of new section 18 and the cross-headings above them (page 16, lines 24 to 32).
Explanatory note
This Amendment Paper amends clause 8 of the Sentencing (Reform) Amendment Bill to remove exceptions to the limit on imprisonment of a person under 18 years. Sentences of imprisonment contravene the right of mokopuna to the least restrictive response to offending as guaranteed under the Oranga Tamariki Act 1989 and the United Nations Convention on the Rights of the Child. The establishment of further exceptions creates increased opportunities for sentences of imprisonment on mokopuna.
