Clause 5A
In clause 5A, delete new section 8A(3)(d) (page 6, lines 18 and 19).
Clause 7
In clause 7, delete the cross-heading above new section 9O (page 15, lines 6 and 7).
In clause 7, delete new sections 9O to 9Q (page 15, lines 8 to 36).
In clause 7, new section 9R, replace “9K, or 9O” with “or 9K” (page 16, line 4).
Explanatory note
This Amendment Paper amends the Sentencing (Reform) Amendment Bill to remove the arbitrary 40% cap on sentencing discounts. Capping sentencing discounts will likely have a chilling effect on the sentencing purposes of rehabilitation and restorative justice, as well as a negative effect on early guilty pleas. It is counterintuitive to apply a randomly selected percentage as a cap on sentencing discounts where part of the aim of sentencing is to rehabilitate (and thereby reduce recidivism) and to encourage restorative justice.
