Dr Lawrence Xu-Nan, in Committee, to move the following amendments:
Clause 5A
After the amendment to clause 5A, new section 8A(2) (page 1), insert:
In clause 5A, delete new section 8A(3)(c) (page 6, lines 16 and 17).
Clause 7
Replace the amendments to clause 7, new section 9NA (page 2), with:
In clause 7, delete the cross-heading above new section 9K (page 13, line 16).
In clause 7, delete new sections 9K to 9NA (page 13, line 17 to page 14, line 17).
After the amendment to clause 7, new section 9NA(2) (page 2), insert:
In clause 7, delete new section 9O(4)(c) (page 15, lines 25 and 26).
In clause 7, new section 9R, delete “9K,” (page 16, line 4).
Explanatory note
This Amendment Paper amends Amendment Paper No 244 amending the Sentencing (Reform) Amendment Bill. It amends clause 7 to retain discounts in sentencing where the offender expresses remorse and attempts to fully or partially remedy the harm caused by the offending. Limiting the use of the remorse discount is counterproductive to the principles of restorative justice. Without any benefit in sentencing outcomes, offenders may redirect their resources elsewhere. This undermines restorative justice outcomes and true accountability to the victim, as well as potentially removing the prospect of a remedy to the harm they experienced. Restorative justice processes have positive outcomes for both victims and offenders by reducing recidivism and improving victim satisfaction with the sentencing (and overall justice) process.
