Clause 15
In clause 15, new section 236C, after subsection (3) (page 21, after line 8), insert:
Good and sufficient reason for failure to meet requirements
(3A)
For the purposes of subsection (1)(b) and section 236D(1)(b), a good and sufficient reason includes, without limitation, any of the following:
(a)
there are no roles available that are appropriate for P:
(b)
there are health and safety risks relating to the community work experience:
(c)
the community work experience would impose excessive travel burdens on P:
(d)
the community work experience would conflict with P’s childcare arrangements:
(e)
the organisational culture of the community or voluntary sector organisation would be harmful to P.
Explanatory note
This Amendment Paper amends the Social Security Amendment Bill. It would include a non-exhaustive list of valid reasons for someone to fail to meet community work experience requirements, including a lack of available roles, health and safety risks, excessive travel burdens, conflicts with childcare, or a harmful organisational culture. There are a range of reasons why community work experience would not be appropriate for a beneficiary, and this amendment will help ensure that beneficiaries unable to meet community work experience requirements are not unfairly penalised when there is a good reason for failing to meet this requirements.
