Lan Pham, in Committee, to move the following amendments:
Clause 29
After clause 29, new section 88BA(2) (page 22, after line 31), insert
(2A)
Despite subsection (1), a consent authority may extend the time period if it has requested further information from the applicant under section 92(1) or commissioned a report under section 92(2).
(2B)
An extension under subsection (2A) must not be for longer than is necessary for the information requested or commissioned to be available.
In clause 29, new section 88BA(5), after “If the time period is extended”
(page 23, line 25), insert “(other than an extension under subsection (2A))”
.
Explanatory note
This Amendment Paper amends the Resource Management (Consenting and Other System Changes) Amendment Bill. Time period extensions should be granted if further information is required to support decision making, particularly relating to environmental effects which are not always immediately obvious or clear in consenting applications
