Explanatory note
This Amendment Paper amends the Resource Management (Consenting and Other System Changes) Amendment Bill to delete clause 43. This clause is an arbitrary amendment to make to primary legislation and would be better dealt with in a national direction instrument to guide consent authorities on longer or shorter periods. Extending the lapse period by doubling it to 10 years or longer for renewable energy activities does not align with the overall policy rationale that we should be encouraging these developments to be undertaken more swiftly. Allowing for an extended time frame has the potential to invite land banking, effectively locking up resources.
