Proposed amendment
Tangi Utikere, in Committee, to move the following amendment:
Clause 17
After clause 17(2)(c) (page 45, after line 34), insert:
(d)
must meet all applicable national environmental standards made under section 43 of the Resource Management Act 1991 and ensure that no net decline in freshwater quality or ecosystem health occurs within its service area; and
(e)
must identify how the delivery of water services will ensure compliance with drinking water standards made under section 47 of the Water Services Act 2021; and
(f)
must identify how the delivery of water services will ensure compliance with any protection of public health obligations in the Health Act 1956; and
(g)
that is a territorial authority must not establish a water organisation under section 36 unless a referendum is held in accordance with section 9 of the Local Electoral Act 2001 and a majority of electors voting in the referendum voted in favour of the establishment; and
(h)
must hold an annual public meeting within 6 months of the end of each financial year where it must conduct a question and answer session and present its annual report and its financial statements for that financial year.
Explanatory note
This Amendment Paper would amend clause 17 of the Local Government (Water Services) Bill to ensure that water planning is aligned with national environmental standards, strengthens public health protections in water service delivery, ensures community approval before major water service restructuring, and ensures accountability through annual public meetings.
