Proposed amendment
Kahurangi Carter, in Committee, to move the following amendment:
Clause 16
Replace clause 16(a) (page 8, line 2) with:
(aaa)
replace “72” with “3”; and
(a)
delete “, or on more than 3 consecutive days (whether continuously or not),”; and
Explanatory note
This Amendment Paper amends Part 3 of the Responding to Abuse in Care Legislation Amendment Bill, which makes changes to the Oranga Tamariki Act 1989, and will prevent children and young people being kept in secure care for longer than 3 hours. This is supported by the Oranga Tamariki Paper “Issues in Residential Care: Secure Care”, where it recommends reducing the time limit for secure care and protection residences to a maximum of 3 hours (either through legislation or practice) and further states that “the coercive powers and environments used to place children and young people in secure care can be re-traumatising and mana diminishing. The current secure care framework does not align with the organisation’s aspirations to provide therapeutic and trauma-informed care”.
