Proposed amendment
Kahurangi Carter, in Committee, to move the following amendment:
Clause 28: New section 384KB
In clause 28, after new section 384KB(2) (page 15, after line 18), insert:
(3)
For the purposes of this section, an authorised person is—
(a)
a member of staff whose work involves searching persons entering the youth justice residence or vehicles entering the secure perimeter of the residence; but
(b)
not a person who carries out work under a contract for services with the chief executive.
Explanatory note
This Amendment Paper amends Part 3 of the Responding to Abuse in Care Legislation Amendment Bill, which makes changes to the Oranga Tamariki Act 1989. This amendment specifies that contractors may not be authorised to use force against youth justice residents. Ensuring that only staff can be authorised to use force will allow for increased checks and safeguards, and minimise the use of institutional practices. This aligns with the Royal Commission of Inquiry into Historical Abuse in State Care and in the Care of Faith-based Institutions’ Final Report recommendations 70 to 75.
