Land Transport Management (Time of Use Charging) Amendment Bill
Proposed amendments
Hon Julie Anne Genter, in Committee, to move the following amendments:
Clause 4
In clause 4, new section 65A, insert in its appropriate alphabetical order (page 4, after line 16):
approved vehicle emissions standard has the same meaning as in Part 2 of the Land Transport Rule: Vehicle Exhaust Emissions 2007
In clause 4, replace new section 65B (page 5, lines 10 to 12) with:
65B Purpose of time of use charging scheme
The purpose of a time of use charging scheme is to—
(a)
improve traffic flow in order to improve network productivity; and
(b)
encourage the use of lower emission vehicles in order to reduce emissions and improve air quality.
In clause 4, new section 65D(1), after paragraph (a) (page 6, after line 5), insert:
(aa)
encourage the use of lower emission vehicles by having different charges based on emissions levels; and
In clause 4, new section 65D, after subsection (1) (page 6, after line 7), insert:
(1A)
The scheme proposal must provide for different charges to apply for vehicles based on—
(a)
their charging class of motor vehicle; and
(b)
whether they meet the approved vehicle emissions standard for their charging class of motor vehicle.
In clause 4, new section 65D(2), replace paragraphs (d) and (e) (page 6, lines 16 to 20) with:
(d)
the maximum charges proposed (which must be consistent with regulations made under section 65ZH) for vehicles based on—
(i)
their charging class of motor vehicle; and
(ii)
whether they meet the approved vehicle emissions standard for their charging class of motor vehicle; and
(e)
a schedule of the operating times and charges (differentiated by emissions levels and charging class) that are proposed to apply to each time of use charging area; and
In clause 4, new section 65H(2), replace paragraphs (c) and (d) (page 8, lines 17 to 22) with:
(c)
set the maximum charge payable under the time of use charging scheme, in accordance with regulations made under section 65ZH, by vehicle based on—
(i)
their charging class of motor vehicle; and
(ii)
whether they meet the approved vehicle emissions standard for their charging class of motor vehicle; and
(d)
set out a methodology by which the maximum charges payable under the time of use charging scheme may be increased over time; and
In clause 4, new section 65H(2A), replace paragraph (a) (page 9, lines 1 to 3) with:
(a)
set a maximum charge payable over a particular time period under the time of use charging scheme, in accordance with regulations made under section 65ZH, by vehicle based on—
(i)
their charging class of motor vehicle; and
(ii)
whether they meet the approved vehicle emissions standard for their charging class of motor vehicle; and
In clause 4, new section 65J(1), replace paragraphs (a) and (b) (page 10, lines 1 to 5) with:
(a)
not more than the maximum charge payable by vehicle based on—
(i)
their charging class of motor vehicle; and
(ii)
whether they meet the approved vehicle emissions standard for their charging class of motor vehicle—
set by an Order in Council made under section 65H; and
(b)
in accordance with regulations made under section 65ZH setting out the charging classes and charging ratios for different motor vehicle types and emissions levels.
In clause 4, new section 65L, replace subsection (3) (page 11, lines 10 to 14) with:
(3)
Sections 65D, 65F, and 65G apply to a proposal to increase the maximum charges payable by vehicle based on—
(a)
their charging class of motor vehicle; and
(b)
whether they meet the approved vehicle emissions standard for their charging class of motor vehicle—
in a time of use charging scheme, in accordance with a methodology to increase the maximum charges payable set out in an Order in Council made under section 65H.
In clause 4, new section 65Z(1), replace paragraph (b) (page 21, lines 8 to 13) with:
(b)
any proposed variation to a time of use charging scheme under section 65L, except for a proposal to increase the maximum charges payable by vehicle based on—
(i)
their charging class of motor vehicle; and
(ii)
whether they meet the approved vehicle emissions standard for their charging class of motor vehicle—
in a time of use charging scheme in accordance with a methodology to increase the maximum charges payable set out in an Order in Council made under section 65H; and
Explanatory note
This Amendment Paper amends the Land Transport Management (Time of Use Charging) Amendment Bill. It would allow time of use schemes to be expanded to allow for additional charges on vehicles that do not meet recent vehicle exhaust standards.
When the Transport and Infrastructure Committee in the 53rd Parliament was conducting an inquiry into congestion pricing,1 it heard from many expert submitters that it should design legislation to allow for low emissions zones, which have worked very well overseas.
Congestion is just one negative impact of our car-dependent transport system, and the cost of congestion is not as high as the negative impacts on health and productivity from air pollution, for example, or carbon emissions.
Research from New Zealand and around the world has demonstrated negative productivity impacts from air pollution, including the HAPINZ 3.0 report. Recent research from the OECD demonstrated that a third of labour productivity growth in Europe from 2010 to 2019 could be explained by improvements in air quality.
Air pollution from motor vehicles in New Zealand was found to have directly caused approximately $10 billion in social costs each year, including 13,000 cases of childhood asthma prevalence. Low emission zones have had a measurable impact on health outcomes where these zones have been used in other jurisdictions.
Low emissions zones are an additional tool territorial authorities and road controlling authorities should have available to them to get better outcomes in our urban areas.
