Clause 4: new section 65X
In clause 4, new section 65X(3)(b), replace “within, and around” (page 19, line 26) with “and within”.
Explanatory note
This Amendment Paper amends clause 4 of the Land Transport Management (Time of Use Charging) Amendment Bill to require an investment agreement to prioritise activities that improve the ability of people to move into, out of, and within the scheme area. Investment agreements ought to prioritise investment in transport options that help people to better travel through and within the scheme area. However, the use of the word ‘around’ risks investment agreements spending the charging revenue on transport projects that are unrelated to the scheme area, but happen to be geographically nearby or around the area. The word ‘within’ already requires agreements to prioritise activities that improve people’s ability to travel throughout the scheme area. This Amendment Paper clarifies that investment agreements must prioritise activities that improve the ability of people to move into, out of, and within the scheme area, not for activities around the scheme area.
