Proposed amendments
Francisco Hernandez, in Committee, to move the following amendments:
Clause 5
In clause 5(5), definition of anchor polytechnic, replace “section 315”
(page 8, line 12) with “section 315A”
.
Clause 22
In clause 22, new section 315, replace subsection (3) (page 12, lines 5 to 7) with:
(3)
An order may specify the region or regions served by the polytechnic.
In clause 22, new section 315, delete subsection (4) (page 12, lines 8 to 10).
In clause 22, after new section 315 (page 12, after line 14), insert:
315A Specification or removal of specification of anchor polytechnics
(1)
The Governor-General may, by Order in Council made on the recommendation of the Minister, specify that a polytechnic is an anchor polytechnic.
(2)
Before making a recommendation, the Minister must—
(a)
seek and consider advice from—
(i)
the TEC on the viability of the polytechnic over the long term; and
(ii)
NZQA on quality assurance matters; and
(b)
consult the polytechnic being considered for specification as an anchor polytechnic; and
(c)
consult the Federation Committee; and
(d)
consult other persons or bodies that the Minister thinks fit; and
(e)
be satisfied that the specification is in the interests of the education and training system as a whole.
(3)
Before recommending that a polytechnic be specified as an anchor polytechnic, the Minister must be satisfied that the polytechnic is able to perform the role of an anchor polytechnic specified in section 337.
(4)
An order made under this section may specify the conditions that a polytechnic must satisfy before the specification takes effect.
(5)
The Governor-General may, by Order in Council made on the recommendation of the Minister, remove the specification of a polytechnic as an anchor polytechnic.
(6)
However, before removing a polytechnic’s specification as an anchor polytechnic, the Minister must—
(a)
consult the polytechnic whose specification is being considered for removal; and
(b)
consult the Federation Committee; and
(c)
consult any polytechnic that procures or commissions services from the anchor polytechnic; and
(d)
be satisfied that the polytechnic remaining as an anchor polytechnic is no longer necessary or expedient—
(i)
for the federation polytechnics to deliver the programmes and carry out the activities consistent with the characteristics of the polytechnics; and
(ii)
to support the educational performance, operation, and viability of the federation polytechnics.
(7)
An order made under this section is secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
In clause 22, new section 323(1)(a), replace “section 315(3)(b)”
(page 14, line 36) with “section 315A”
.
