Proposed amendment

Dr Lawrence Xu-Nan, in Committee, to move the following amendment:

Clause 12

In clause 12, new section 281A(2), after paragraph (f) (page 7, after line 9), insert:

(g)

universities must continue to give effect to relevant student rights set out in this Act, the New Zealand Bill of Rights Act 1990, and the Human Rights Act 1993.

Explanatory note

This Amendment Paper amends the Education and Training Amendment Bill (No 2). Freedom of expression is not the same as freedom from consequences. This is a fundamental error that some political ideologies make. By platforming hate speech and rhetoric under the guise of freedom of expression, it places universities in a dichotomy with their mandate to ensure the safety of their students and staff. By including a requirement to give effect to the New Zealand Bill of Rights Act 1990 and the Human Rights Act 1993, this dilemma is somewhat mitigated.
